Welcome to EarSightings, a fan-made community for sharing and voting on photos of Hidden Mickeys at Walt Disney World. These Terms of Service ("Terms") are a legal agreement between you and EarSightings ("we", "us", or "our"). By accessing or using the site, you agree to these Terms. If you do not agree, please do not use the site.

1. Eligibility

You must be at least 13 years old (or older, where required by your local law) to use EarSightings and to create an account. If you are under the age of majority where you live, you may use the site only with the involvement of a parent or legal guardian.

2. Your account

You are responsible for the information you provide, for keeping your account credentials secure, and for all activity that occurs under your account. Please provide accurate information and notify us if you believe your account has been compromised.

3. Not affiliated with Disney

EarSightings is an independent, fan-made project. It is not affiliated with, endorsed by, sponsored by, or in any way officially connected to The Walt Disney Company or any of its subsidiaries or affiliates. "Disney", "Hidden Mickey", and related names, marks, and images are the property of their respective owners and are used here only for the purpose of identification and community discussion.

4. Your content

You keep ownership of the photos and other content you submit ("Your Content"). By submitting Your Content, you grant us a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, and distribute it for the purpose of operating and promoting the site. This license ends when you delete Your Content or your account, except for content others have already interacted with or copies retained as required by law.

You represent and warrant that you own or have the necessary rights to the content you submit, that you took the photos yourself or have permission to share them, and that Your Content does not violate the rights of any third party or any law.

5. Acceptable use

When using EarSightings, you agree not to submit or do any of the following:

• Content that is illegal, infringing, sexually explicit, harassing, hateful, threatening, or violent.
• Sexual, exploitative, or abusive content involving minors of any kind.
• Photos of identifiable people posted without their consent.
• Spam, advertising, off-topic content, or content that is not a genuine Hidden Mickey sighting.
• Attempts to manipulate votes, impersonate others, or misrepresent your identity.
• Any attempt to disrupt, overload, hack, or gain unauthorized access to the site or its systems.

6. Moderation and removal

Uploaded images may be automatically screened, and all content may be reviewed by our moderators. We may, at our discretion and with or without notice, remove, archive, or refuse any content, and suspend or terminate any account, that we believe violates these Terms or is otherwise harmful. We are not obligated to host or display any content.

7. Copyright and takedown requests

We respect intellectual property rights. If you believe content on EarSightings infringes your copyright, contact us at earsightings email with: a description of the work, the location (URL) of the material on our site, your contact information, a statement that you have a good-faith belief the use is not authorized, a statement that the information is accurate and that you are the rights holder or authorized to act on their behalf, and your signature. We will remove or disable access to infringing material and may terminate the accounts of repeat infringers.

8. Our intellectual property

The EarSightings name, logo, design, and the site itself (excluding Your Content and third-party marks referenced above) are owned by us and protected by applicable laws. You may not copy, modify, or reuse them without our permission.

9. Disclaimers

EarSightings is provided "as is" and "as available", without warranties of any kind, whether express or implied. Content is submitted by users and is not verified by us; we do not guarantee the accuracy, quality, or reliability of any Hidden Mickey location, description, or other user content. Your use of the site is at your own risk.

10. Limitation of liability

To the fullest extent permitted by law, EarSightings and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising out of or related to your use of the site. Our total liability for any claim relating to the site will not exceed one hundred U.S. dollars (US $100).

11. Indemnification

You agree to indemnify and hold harmless EarSightings and its operators from any claims, damages, liabilities, and expenses arising out of Your Content, your use of the site, or your violation of these Terms.

12. Termination

You may stop using the site and delete your account at any time. We may suspend or terminate your access at any time if you violate these Terms or for any other reason at our discretion.

13. Governing law

These Terms are governed by the laws of Connecticut/United States of America, without regard to its conflict-of-laws rules. Any disputes will be resolved in the courts located in that jurisdiction.

14. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Your continued use of the site after changes take effect means you accept the updated Terms.
